Our Second Year Report 

Since this is the beginning of our second year, it is a good time to look back at some of the accomplishments we have had since we were charted.  

First and foremost is of course the right to representation. Previously employees with problems could not have anyone speak on their behalf. Even during hearings, if they brought a lawyer with them, the lawyer could only pass notes to the employee. This was wrong. Before we were even chartered, our lawyers from Pittsburgh wrote to the State Attorney General who ruled against the city, citing that those restrictions were illegal.  

We also joined in the fight and organized rallies to keep the city from giving the employees a five percent pay cut to balance the city budget. The threat of our publicizing and activating the city employees enabled us to maintain at least some SIP at the same levels that the uniformed employees receive by state mandate, and cut short the threats to eliminate earned sick time payout at retirement.  

Last year we joined with the retires and got all employees a $500.00 medical benefits stipend in their January paycheck, and made sure that city cell phone re-imbursements were raised enough to cover the actual base cost.  

We developed a communication system (email, fax, phone and internet) to keep employees from being constantly blindsided by city management. And this year, despite vigorous opposition from the Mayor, we assisted in convincing council that the civilian employees deserved more than a capped merit increase that would not take place until late spring. This means that all civilian employees will be receiving a 2% Cost of Living Adjustment this January.  

Not too shabby for a new organization, but the fight is nowhere near over. We civilian employees are under unrelenting attack from the mayor, some members of council and certain parts of city management. Now is the time to unite if we intend to save our jobs, the meager benefits and protections left to us and start the push to regain what has been taken from us. We need to stand together for change, so that next year we can move forward, rather than try to maintain the status quo.

Message for non-members

Numerous times our members report that non-members tell them, I would join, but you (the association) are just are not doing enough...
  
Ummm, newsflash people. Not only are we doing more than enough, in fact we are doing more than our share.
   
You who belong to NO association are the ones who are not doing enough. In fact you are doing exactly nothing and then complaining that change is not happening fast enough. How selfish is that?
 
If you want something to happen, you had better do SOMETHING to make it possible. You can speak in front of council, attend a pension board meeting, create an informational web site, write complaint letters to influential people… or… join an Employee Association.
   
Or you can sit and do nothing but whine.
    
Miller laughs at you. She constantly points out how the police get what they want because 100 percent of their department belongs to an employee association. She knows you; she knows how short sighted many civilian employees are and how they refuse to help themselves because it will cost them a few bucks a month.
 
One voice hollering on a corner is not heard over the noise of the city, especially not this city. But hundreds of voices chanting together can be heard for miles. So, this brings us back to the question of, “What are YOU going to do? Take some positive action to better your future? Or just sit on your rump and complain?

Civil Service Protections Under Attack!

As part of the cluster bombing that is going on against Dallas City employees, we understand that the Civil Service reforms are steaming full speed ahead. I have looked at the time line on this process and amazingly enough; I see no place for input by the employees.  Well, unless one counts that lame slanted poll that was stuck up to see who knew the difference between the functions of Human Resources and the Civil Service department?  

I can give you the differences in a nutshell. Civil Service was implemented to reduce favoritism and patronage in job postings and hiring. It also acts as a court of last resort to save the city from lawsuits resulting from firings due to inept supervisors and illegal acts by management and elected officials.  

Human Recourses exists to implement city policy, assist the departments when they are preparing to dismiss an employee and oversee the benefits we use to receive. Please understand, I like and admire quite a few HR people, but as any employee with a problem supervisor can tell you, they are not there to assist the rank and file in any meaningful way.  

Let me put it another way. One of the arguments they are going to use for this action is that these rules are outdated and unnecessary since there are federal and state laws on the books that provide similar protection for workers. The argument that they are going to ignore is that many laws and programs EXHEMPT government and municipal employees from their jurisdiction.  

Otherwise employees would have received assistance from the Texas Workforce Commission when our payroll was so screwed up that numerous employees where being shortchanged on their pay week after week. You know what those employees were told by the TWC? Hire a lawyer; we cannot file charges against an entity of the State government.  

It is also why the OSHA officials who went out to the Southside Waste Water Treatment plant last month were unable to file any charges or even make a report on their findings. Why? Because we municipal employees do not fall under OSHA protections, protections that the lowest employee in the private sector has access too.

This process is of course being fast tracked because Mayor Miller wants to get it done while Ted is here to do the dirty work. This way she gets to use his stature this one last time with the council members who still support him. I have personally heard her say that the city needs to change the rules to make it easier to get rid of the dead wood. This of course would make it easier to hire the ‘young and spunky.’ Seems a bit simplistic and ageist to me.  

One other reasons that the Civil Service was put into place was to stop the ‘spoils system’ where by government employees (us) under the influence of powerful business or political interests apportioned money to projects not on the basis of need, but on the basis of influence.   

Without Civil Service, we have the planning department trying to decide who threatens their job more, the big business trying to get an exemption or the neighborhood home owners group. I understand that some of our elected officials do not think very highly of our collective intelligence, but I assure you, we can add up the numbers in a situation like this. We will be asking our employees to put their families’ livelihood on the line every time they have to make a difficult decision.  This is only going to make working for the city less attractive than it already has become.  

Call your council person and let them know how this is going to affect you. Alert your family members and friends to this looming problem. Should these changes go through, look for numerous lawsuits and scandal to follow in its foot steps. Not to mention acceleration in the flight of skilled employees. – M. R. Frey

Check Your Pay Stub NOW! 

Twice last week I spoke to employees who thought they were members of our association but were not. Somehow, their dues were going to the TPWA instead of the Steelworkers!  Our designation on the city pay stubs is NT pub E, which is short for North Texas Association of Public Employees Steelworkers #9479

To say that these gentlemen were upset would be an understatement, especially since one of them had just been served with a very serious charge that he needed assistance with.  

What happened? Well in the case of the first gentleman, it appears to be a case of misrepresentation. He stated that he had signed up at one of the first Steelworker rallies. As some of you may recall, TPWA and Carpenters Union representatives showed up at these evens and were collecting cards off of city employees with out telling them that they were NOT with the steelworkers.  We even found a few cards where the Carpenters Union had crossed off our name and written in their own before submitting them.  

The second case was a mistake. That gentleman was a TPWA member, who sent in a card to cancel his membership in that group after we were chartered. Apparently, they cancelled us from his payroll records by mistake. At least I would like to think it was a mistake. But the fact of the matter is, many people have been dropped or had similar mistakes made with all the problems payroll has had this last year. Please check your stub now. We need to get this taken care of with payroll once and for all.  

If you signed up, but dues are no longer being deducted, we need to talk to payroll about it. And of course, if your dues are going to some other organization, we definitely need to fix that. Call 214-760-7422 immediately.

Proposition 1 Vote

The elections this November are not only important to labor as a whole, but also to us City of Dallas civilian employees.  

Prop 1 is your chance to vote on the changes that need to be made to keep our pension fund solvent. It raises the contributions for both us and the city and then floats them in the future, so we don’t have local politics delaying any needed increases. It also adds two more people to the ERF board (one employee, one council appointee) and adjusts the ERF terms to reflect the additional board members.  Tell your friends and family to VOTE YES ON PROP 1

Retirees are Shut Out!

Mr. Griffith reports that the Civilian Retirees were unable to get any appointments to meet with various city council members during this last budget go round.  When you think about how many high powered former employees their executive board has, it is truly unsettling. The civilian retirees were not given a chance to discuss retiree health benefit costs one on one with any council member?

Is this what we have to look forward to in a few years? Years of sacrifice and budget cutting while we are employees and then more of the same and worse once we retire?  

Why? Treatment like this may accelerate employee flight in the mid level area, employees with 10-15 years of service. With current benefits eroding, quite a few people are wondering what incentive there is in remaining with the City of Dallas ?

The retirees are a cautionary tale for all civilian employees. Many employees who are close to the Rule of 78 are seriously considering jumping ship at the first opportunity. After all, if you retire young enough, you have time to get another job with a company or municipality that has some retiree health benefits that will not consume larger and larger chunks of your income every year.

Workers Comp Pitfall

Previous newsletters we have mentioned the financial straits that one of our associates is having due to an flare up from an injury that occurred several years ago, no short term disability and a workers comp snafu.  

Amazingly, he is not alone. A mechanic (not an associate) in streets is having the same problem, and both seem to stem from an impairment settlement for the original injury. While the mechanic is not going to be off the job long enough to suffer any dire financial problems, he is upset that this re-occurrence is going to cost him almost all of his remaining sick time, all for a $600.00 impairment settlement.  Do not accept an impairment settlement that limits your future rights to salary assistance. Sometimes it is not worth the money offered. For a $600.00 dollar settlement, the mechanic lost 6 weeks in wages as his new surgery heals. It is just not worth it.

Increasing Out of Pocket on Health Benefits

It came as a complete surprise to everyone at the Medical Benefits Work group when we found out that the out of pocket (OOP) amounts are going to be increasing next year. Apparently the OOP is going to go up when the Medical Benefit and the Prescription plan are combined.  

I will be honest, it was explained twice, and I still could not make sense of ‘why’ and increase is happening. I will see if one of our benefit guru’s can write up an explanation for us for a future bulletin.  One thing however that was crystal clear was the aggravation felt by the group members when they found out that this decision had been made prior to our first meeting.

Bucks for You!

Help grow your union and get paid. You can earn  $10.00 for each member you sign up! And they get a hat and the knowledge that they taking a positive step towards creating a better workplace. How?

Any current steelworker member who signs up a fellow employee for the Steelworkers will be given a $10.00 incentive for each new member they sign up. The payment will be made as soon as the new member shows up on the membership list that the city gives us. Incentive payments, which can be accumulated, can be picked up at the end of the monthly meetings. Also, the new members can pick up a Steelworkers ball cap at the end of those same monthly meetings. Of course, if you are a currently steelworker who does not have a ball cap, you may also pick one up at the end of our monthly meetings.

Helping the Troops at Christmas Project 

The following is a request from one of our members. As we know, many of the people over in Iraq are on extended tours and doubtless could use all the cheering up they can get. In previous wars, it was possible to send general delivery items to the troops to boost their morale. Sadly due to the mixed feelings that some people have about the war and the hateful things that have been sent to the troops in Iraq the military is only forwarding care packages from know family members or known support groups. This is a bit of a hardship on the lower ranking troops, who’s families cannot afford to support themselves, let alone mail regular packages. Please see the following....  

I am a member of the Steelworkers and also an employee of the City of Dallas .  I am also involved with the Ellis County Military Moms in supporting our troops in Iraq .  My husband and I have adopted two young men in the First Cav Division out of Fort Hood .  One of our soldiers heads up a squad of nine people, 10 counting himself.  A number of these soldier either have no family or the family is unable to provide them with care packages.  We are prohibited from releasing the names or addresses of these soldiers.  However, I can tell you that some of these individuals in the First Cav are from Dallas, Ellis County and some other nearby counties.  These boys and girls fighting for our freedoms deserve our support. These boys and girls are children, grandchildren, other family members, members of your church, and your co-workers.  Something as little as a letter will boost their morale.  My husband and I can only support two people by ourselves, but I am asking for support from the membership to help support the entire squad of 10.  This particular squad is all young males.  This project will be very important especially during the holidays. 

The following items can be donated.  If you can not afford to donate anything, a general letter of support or card would be helpful.  The letters and cards must not be in sealed envelopes, but left open.  If you choose to make a small money donation, it will be used to mail boxes.  All money will be accounted for by postal receipts.  Money may be given to President Michelle Frey, who will provide it to myself.  All items will be boxed and mailed by myself, unless enough people are interested in a special Christmas project, which would have to be mailed in October.
